Welcome to Shiv. These Terms of Service (“Terms”) govern your use of our website and all services provided by us, including but not limited to CAD design and 3D rendering (“Services”). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
You must be at least 18 years old to use our Services. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Services
Shivo provides custom CAD design and 3D rendering services for the jewelry industry. Our Services are delivered digitally as per the agreed-upon project scope. We are not a manufacturer and are not responsible for the physical production of jewelry.
3. Pricing and Payment
All prices are listed in INR and are subject to change. Full payment for the agreed-upon Services is required upfront, unless otherwise arranged. By submitting your payment information, you authorize us to charge you for the Services.
4. Intellectual Property
Upon final payment, the client is granted a non-exclusive, perpetual license to use the final CAD models and renders for commercial purposes. Shiv retains the right to display the final work in our portfolio for promotional purposes unless otherwise agreed upon in writing.
5. Client’s Content
You are solely responsible for the content, including any images or sketches, that you provide to us. You warrant that you own the rights to this content or have the necessary permissions to use it and that it does not infringe upon any third-party intellectual property rights.
6. Cancellations and Refunds
The terms for service cancellation and refunds are governed by our Refund and Cancellation Policy, which is incorporated by reference into these Terms.
7. Disclaimers and Limitation of Liability
The Services are provided “as is,” without warranties of any kind. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services. You acknowledge that final physical products may vary slightly from the digital renders due to manufacturing processes.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
